"Winny" developer Kaneko Isamu convicted and fined 1,500,000 yen

On the 13th at the Kyoto District Court upheld a guilty verdict for
Mr. Isamu Kaneko on the charges of assisting copyright violations, and
sentenced a 1,500,000 yen fine (one year of penal servitude proposed).

This judgement process has begun since November 2003, when two Winny
users were arrested on charges of copyright violations, Mr. Kaneko is
then persecuted on crime of assistance.  Regarding the two users who
were arrested earlier, they will be sentenced one year in prison, with
stay of execution for 3 years.

For Winny developer Mr. Kaneko, the persecution claims "it's a program
developed and distributed with the intent of violating copyright laws,
and that the accused's act of allowing indefinite number of downloads
makes this assistance crime obvious," and proposed one year of penal
servitude.  On the other side, the defense claims "Winny was made with
the intent to develop new technology, and the act of spreading
copyright violations claimed by the persecution are incorrect," and
pleaded innocent to the charges.
